Diane Myint Luczon

Diane Myint Luczon is a litigation partner at Early Sullivan.  Prior to joining Early Sullivan, Ms. Luczon was a litigation associate at Glaser Weil where she worked on a broad variety of both state and federal matters, including actions that involved banks, governmental entities and insurance companies. She has been selected for inclusion in “The Best Lawyers in America” in 2023 and 2024 for Commercial Litigation. Ms. Luczon received her Juris Doctorate from the University of Southern California in 2004.  Prior to attending law school, Ms. Luczon  received her Bachelor of Arts in Economics and Political Science, magna cum laude,  from the University of California, San Diego in 2001.

Title Insurance

• Successfully obtained judgment in favor of a title insurance company, which was affirmed on appeal. Through Diane’s efforts, the trial court sustained the title company’s demurrer to the plaintiff’s complaint, which alleged claims for negligence, negligent misrepresentation, breach of oral contract and abstractor negligence. The trial court held that a plaintiff who did not purchase a title policy or retain the title company to provide the services of an abstractor could not hold the title insurance company liable for his purported losses. The Court of Appeal affirmed the judgment in a published opinion, Soifer v. Chicago Title, 187 Cal. App. 4th 365, 114 Cal. Rptr. 3d 1 (2d Dist. 2010) adopting the arguments that Diane co-authored in the respondent’s brief.

Constitutional Rights

• Successfully defended the County of Los Angeles in a Section 1983 action filed by employee in Federal District Court. The district court granted the County’s motion to dismiss the plaintiff’s deprivation of due process and violation of equal protection claims. In addition, the district court granted the County’s Motion for Summary Judgment in it entirety, holding that plaintiff’s First Amendment claim failed as a matter of law. The Ninth Circuit affirmed the judgment in favor of County.

Employment

• Obtained a defense verdict for her client in a wage and hour employment suit by establishing that the plaintiff had been compensated for all overtime hours through a mutual wage agreement.

Banks

• Represented a national bank in multiple actions where a borrower had defaulted on loans. Diane was successful in obtaining judgments in favor of the Bank to recoup the loan proceeds.
