Bryan Sullivan’s articles “Byron Allen Loses Racial Discrimination Supreme Court Case” and “Byron Allen Racial Discrimination Case To Be Considered” were published onĀ ForbesĀ on March 23 and March 30, 2020. In both articles, Bryan discusses the decision that was reached in a racial discrimination lawsuit filed against Comcast by comedian-turned entertainment entrepreneur Byron Allen. The U.S. Supreme Court unanimously ruled that Allen’s company Entertainment Studios Network (ESN) bore the burden of showing that race was the “but-for” cause of injury in the case. However, the Supreme Court later ordered the 9th Circuit Court of Appeals to reconsider its decision after clarifying the standard of proof for such cases based on the Civil Rights Act of 1866.
