Bryan Sullivan Pens Forbes Article on Defamation Lawsuits Against Netflix

Bryan Sullivan’s article entitled, “Netflix’s ‘The Queen’s Gambit’ And ‘Inventing Anna’ Subjects Of Defamation Lawsuits” was recently published in Forbes. The article examines the extent to which creators can legally bend and stretch the truth to conform to their storylines, without causing defamation to the real people they are portraying.

Using precedents from “The Wolf of Wall Street” case, Bryan examines what the “based on a true story” tagline means for the industry at large. “With the rise of true crime and historical dramas, producers navigate shaky territory where they balance telling a compelling story without crossing the line into defaming real-life people,” he said. “This requires diligence and creativity as was found in the “Wolf of Wall Street” case where the producers engaged in vetting efforts and created a character from a composite of three people.”

Bryan Sullivan Examines Astroworld Liability For Travis Scott and Others In Forbes and Yahoo! Finance

In a recent article for Forbes entitled “Astroworld’s Legal Fallout: What’s At Risk For Travis Scott And Live Nation?” Bryan Sullivan examines the liability of Scott, Drake, Live Nation Entertainment Inc., and other defendants after the Astroworld tragedy. With a look at the legal outcome of similar incidents, Bryan explains that grounds for liability for Scott or Drake would depend on if they encouraged violent behavior from the crowds.

Bryan spoke with Yahoo! Finance further about Travis Scott’s liability following the incident, telling reporter Alexandra Canal that “The law requires him to engage in specific conduct that incited the incidents…What did he do at Astroworld that night? That’s the question the courts will be asking.”

Bryan Sullivan’s Article “Trump’s Latest Lawsuit Against New York Times Et Al. Likely To Fail Bigly” Published in Forbes

Bryan Sullivan recently published an article in Forbes detailing a new lawsuit filed by former President Donald Trump against The New York Times, several of its reporters, and his niece, Mary Trump. The lawsuit is centered around thousands of pages of Trump’s tax records, which were obtained by The Times through Mary Trump and served to inform a series of articles about Trump published by the paper in 2018. The lawsuit alleges that there was an “insidious plot” to obtain these tax records and seeks damages of no less than $100 million. According to Bryan, it is highly unlikely that the suit will withstand legal scrutiny, thanks to freedom of the press under the First Amendment and because the actions of The Times and its reporters were in the furthering of the public interest. He highlights several major First Amendment lawsuits and discusses the possible outcomes of this most recent suit based on the Supreme Court’s expansive interpretation of press freedoms.
